Patent battles can destroy billions in pharmaceutical value, especially when a company's biggest products are involved. But resolving those disputes can also remove uncertainty and protect future earnings.

One profitable biotech just secured a major settlement while preparing for two potential drug approvals that could reshape its growth outlook.

What Just Happened

United Therapeutics Corporation (NASDAQ: UTHR) reached a major settlement with rival Liquidia, ending a long-running legal dispute involving competing treatments for pulmonary hypertension.

Under the agreement, Liquidia will pay United Therapeutics $330.4 million in installments through April 2027. United Therapeutics will separately pay $10 million to resolve related litigation, leaving a net benefit of approximately $320 million before any associated expenses.

More importantly, Liquidia agreed to stop promoting its competing Yutrepia treatment for pulmonary hypertension associated with interstitial lung disease, or PH-ILD. It has also requested FDA approval to remove that indication from the drug's label.

Liquidia can continue selling Yutrepia for pulmonary arterial hypertension (PAH), so competition has not disappeared.

However, the agreement significantly strengthens United Therapeutics' position in the PH-ILD market while removing several costly legal disputes.

Why This Market Matters

United Therapeutics specializes in treating pulmonary hypertension, a group of serious conditions involving elevated pressure in the blood vessels supplying the lungs.

Its flagship Tyvaso franchise uses inhaled treprostinil to help manage these conditions. The company sells both a nebulized version and Tyvaso DPI, a dry-powder inhaler that offers patients a more portable treatment option.

Tyvaso generated $452.6 million of second-quarter revenue, representing nearly 58% of companywide sales. That makes protecting the franchise critical to future earnings.

The settlement helps defend one of the company's most important opportunities. United Therapeutics can continue marketing Tyvaso for PH-ILD without Liquidia actively promoting a directly competing product for that indication.

That does not guarantee pricing power or eliminate future competition, but it reduces a meaningful source of uncertainty.

There is another benefit: management can redirect attention and resources away from litigation and toward commercialization, new drug development, and expanding its existing patient base.

The Existing Business Generates Serious Cash

Unlike many biotech companies pursuing major clinical catalysts, United Therapeutics is already highly profitable.

Second-quarter revenue reached $783.3 million, while net income increased 8% to $333 million. Diluted EPS rose 13% to $7.27, helped partly by a lower effective tax rate.

The underlying sales picture was less impressive. Revenue declined 2% year over year, with Tyvaso sales falling 4%. Tyvaso DPI revenue increased 4% to $326.6 million, but the older nebulized formulation declined 18%.

Operating income also declined, highlighting the competitive pressures affecting the existing portfolio.

Still, United Therapeutics ended June with approximately $3.8 billion in cash and marketable investments. Trailing 12-month operating cash flow reached roughly $1.7 billion.

That financial strength is important because the company can fund clinical development, manufacturing expansion, and shareholder returns without depending on repeated equity raises.

Two Potential Blockbuster Catalysts Are Approaching

The settlement protects the existing business, but the pipeline could drive much of the future upside.

United Therapeutics has submitted an FDA application for ralinepag, a once-daily oral treatment for PAH. In its Phase 3 ADVANCE OUTCOMES trial, ralinepag reduced the risk of clinical worsening by 55% compared with placebo.

That is a meaningful clinical result in a serious disease where delaying deterioration can be extremely valuable.

The FDA has also accepted the company's application to expand nebulized Tyvaso into idiopathic pulmonary fibrosis, or IPF.

IPF is a progressive lung-scarring disease with limited treatment options. Positive Phase 3 results suggest inhaled treprostinil could offer an additional way to manage the condition.

Management believes both programs could potentially receive FDA approval in 2027. Neither approval is guaranteed, but successful launches would open new revenue opportunities beyond the existing pulmonary-hypertension franchise.

For you, that creates an interesting combination: an established business generating cash today and late-stage development programs that could accelerate growth tomorrow.

Buybacks Add Another Layer Of Support

Management is also using its substantial cash reserves to reduce the share count.

In September, United Therapeutics announced an accelerated repurchase agreement covering the remaining $477.6 million of its $2 billion authorization.

That followed $1.5 billion of accelerated repurchase agreements earlier in 2026 and another $22.4 million of open-market purchases.

The program is expected to be completed during the fourth quarter, bringing total repurchases under the authorization to $2 billion.

With the stock recently valued around $23 billion and trading at approximately 19 times trailing earnings, United Therapeutics is not priced like a distressed biotech. But it also does not carry the extreme valuation multiples attached to some earlier-stage pharmaceutical developers.

You are paying for an existing profitable franchise, substantial liquidity, and potential new-product growth rather than depending entirely on a single clinical outcome.

Continued repurchases could also support per-share earnings as the company advances its pipeline.

What Could Trip It Up

The biggest risk is that the current business remains under pressure. Tyvaso revenue declined during Q2, and Liquidia can still compete for patients with PAH. The settlement reduces competition in PH-ILD but does not eliminate broader commercial challenges.

FDA decisions create another source of uncertainty. Even successful Phase 3 programs can face regulatory delays, labeling restrictions, or slower-than-expected commercial adoption.

Finally, the company must prove that its pipeline can restore growth. Strong cash flow and buybacks help, but a sustained decline in its existing products could offset some of those benefits.

My Take

Buy on pullbacks. United Therapeutics combines an established, cash-generating drug franchise with improving legal clarity, aggressive share repurchases, and two potentially significant FDA catalysts.

The settlement is especially valuable because it protects an existing revenue stream while management works on the next generation of products.

The key risk is commercial execution. The current franchise is not growing quickly, and much of the upside depends on successful regulatory approvals and launches.

I would build the position gradually, focusing on Tyvaso sales trends, FDA progress, and continued cash generation.
